Our services in Turkey deal with fulfillments of KKDIK/SEA

KKDİK: 

The "KKDIK Regulation" of 23 June 2017 (Regulation no. 30105), also known as Turkish REACH, is the legislation that must manage chemicals placing on Turkey market. It establishes a system for the registration, evaluation, authorization and restriction of chemicals in the Turkish market, on the same way as the REACH EU Regulation.

Substances placed on the Turkish market have to undergo the registration process if handled in quantities equal to or greater than 1 ton per year.

Companies producing and importing chemicals as such or as part of mixtures or articles, in quantities equal to or greater than 1 ton per year, can begin to pre-register their substances with the competent Turkish Ministry, to enjoy the transitional regime and not suffer commercial interruptions.

According to KKDIK there are no different deadlines for various tonnage bands, but all substances > 1ton / y must be pre-registered by 31 December 2020 and subsequently registered by 31 December 2023. Only companies based in Turkey can access the institutional portals and make submissions.

Companies located outside of Turkey can appoint an only representative (OR) to fulfill these obligations.

In addition, and unlike the European REACH, the KKDIK registration dossier have to be signed by a trained and qualified expert (CAE). Similarly, the Safety Data Sheets must be approved by a CAE.

SEA:

The Turkish implementation of the regulation dealing with the classification, labelling and packaging of chemicals (CLP) was published on 11 December 2013 in the Official Gazette at no. 28848 and entered into force on the date of publication. The SEA, as per the Turkish acronym, follows the European CLP and has provided transitional periods for coming into force of its obligations on substances and mixtures.

Starting from June 1, 2016, the old Turkish classification regulation has been completely abolished and the SEA is the only regulation in act regarding the classification, labelling and packaging of substances and mixtures.

Notification to the Turkish C&L inventory is another obligation to comply with SEA. For substances that have been placed on the market for the first time, alone or in a mixture, after 1 June 2015 the notification must be submitted within 30 days from the date of manufacture / import by a Turkish legal entity.

Companies exporting chemicals to Turkey can cover the C&L notification obligation of their importers by appointing an only representative (Article 41 SEA).
